36-year-old Andile Nkomo from Eastern Cape has been sentenced to life imprisonment after the Komani Regional Court found him guilty of raping his former girlfriend near Komani. The National Prosecuting Authority (NPA) confirmed that Andile Nkomo was sentenced after the court rejected his claim that the sexual intercourse was consensual.

The sentence marks the conclusion of a case that began in October 2021 and highlights the justice system’s response to serious sexual offences and gender-based violence. What Happened Between Andile Nkomo and His Former Partner Near Komani

According to evidence presented during the trial, Nkomo and the complainant had ended their relationship in 2020. Despite the separation, the court heard that he allegedly continued to harass the woman and struggled to accept that the relationship had ended.

The offence took place on 24 October 2021 at Dudumashe, Mbinzana, Bolothwa, near Komani in the Eastern Cape.

Evidence before the court showed that Nkomo arrived at the complainant’s home armed with a knife and threatened to force his way into the property. Fearing for the safety of her family members, the complainant left with him.

The court heard that she was assaulted and taken to Nkomo’s home, where he raped her at knifepoint. According to the evidence accepted by the court, she was raped again during the early hours of the following morning.

The complainant later reported the incident to police, leading to Nkomo’s arrest and prosecution.

Evidence Presented During the Komani Regional Court Trial

State Prosecutor Thembelani Stayile led the prosecution’s case and called several witnesses to testify during the proceedings.

Among those who testified were the complainant, her brother, and her daughter. The State also submitted a J88 medico-legal report and DNA evidence as part of its case against Nkomo.

During the trial, Nkomo maintained that the sexual intercourse had been consensual. However, the court rejected his version after considering the prosecution’s evidence.

The acceptance of the complainant’s testimony, together with the supporting medical and forensic evidence, played a significant role in the outcome of the case.

The court ultimately found Nkomo guilty and proceeded to consider an appropriate sentence.

Why the Court Imposed a Life Sentence

Prosecutors argued that the circumstances of the case warranted the prescribed minimum sentence for rape and that there were no substantial and compelling circumstances that would justify a lesser punishment.

The court found that Nkomo’s personal circumstances were outweighed by the aggravating factors associated with the offence.

As a result, he was sentenced to life imprisonment.

In addition to the life sentence, the court declared Nkomo unfit to possess a firearm.
