Arrest Made in Killing of Madlanga Commission Witness Marius van der Merwe
Police have arrested a suspect believed to be involved in the killing of Marius “Vlam” van der Merwe, known publicly as Witness D in the Madlanga Commission of Inquiry.
The arrest follows months of investigation after van der Merwe was shot dead in front of his family in Brakpan in December.
Authorities say the suspect was apprehended in Johannesburg and will appear in the Brakpan Magistrate’s Court on Monday.
The development marks the first breakthrough in the high-profile case that drew national attention because witness D had previously testified about alleged wrongdoing involving law enforcement officials.
Background of the Madlanga Commission Witness D Murder Case
Marius van der Merwe (witness D), a former Ekurhuleni Metropolitan Police Department officer and private security operator, became a key witness in the Madlanga Commission of Inquiry, which is examining alleged corruption and misconduct involving law enforcement officials in Gauteng.
In testimony before the commission weeks before his death, van der Merwe described a troubling incident dating back to April 2022. He alleged that he was asked to assist in a joint operation targeting a robbery suspect in Brakpan.
According to his account, after the suspect died during the operation, he was instructed to dispose of the body to conceal what had happened. Van der Merwe told the commission that he placed the body in a vehicle and dumped it in a dam in Nigel.
He said he complied out of fear for his life.
His testimony implicated senior officials and suggested a pattern of misconduct involving officers from the Ekurhuleni Metropolitan Police Department and the South African Police Service.
Just weeks after delivering that testimony, witness D was shot and killed outside his home in Brenthurst, Brakpan. The killing took place in front of his wife and children, according to reports at the time.
The murder immediately raised concerns about witness safety and whether people cooperating with the commission could be targeted.
SAPS Arrest Suspect in Marius van der Merwe Shooting
The South African Police Service confirmed on Saturday that investigators assigned to cases linked to the Madlanga Commission had made their first arrest in the witness D murder.
The specialised task team was created by National Police Commissioner General Fannie Masemola on the instruction of the President shortly after the commission began producing evidence that required criminal investigation.
Police say investigators gathered significant evidence before applying for a J50 arrest warrant, which allowed them to apprehend the suspect this week.
“The team obtained overwhelming evidence, which resulted in a warrant of arrest being issued,” police said in an update.
The suspect was arrested in Johannesburg on Saturday.
Investigators also seized a vehicle believed to have been used during the attack. Authorities are currently carrying out search and seizure operations at several addresses linked to the suspect.
Masemola praised the investigators for moving quickly in what many viewed as a sensitive case.
“The team is still on the ground, conducting further operations linked to the investigation,” police said.
The suspect is expected to make his first appearance in the Brakpan Magistrate’s Court on Monday, 16 March 2026.

What Happens Next in the Madlanga Commission Witness D Killing Investigation
Although the arrest marks a turning point in the investigation, police say the case is far from complete.
Detectives are continuing to examine possible links between the killing and Witness D’s testimony before the commission. Investigators are also working to determine whether others may have been involved in planning or carrying out the attack.
Legal experts have noted that cases involving witnesses in major investigations often require careful evidence gathering to establish motive and potential accomplices.
The outcome of the investigation could have wider implications for the Madlanga Commission itself, particularly if links are established between the murder and the allegations being examined by the inquiry.
The commission has already highlighted concerns about corruption, abuse of power, and alleged criminal conduct within certain law enforcement structures.
For many observers, the arrest may offer some reassurance that the justice system is responding to the killing of a witness connected to such a significant inquiry.
Still, questions remain about whether Witness D was targeted because of the evidence he provided and whether others connected to the case may face similar risks.
As the suspect prepares to appear in court, investigators are expected to continue gathering evidence that could shed further light on the circumstances surrounding the killing.
The case is likely to remain under close public scrutiny as it moves through the justice system.
